Malema’s Sequestration Finalisation Looming

The leader of the Economic Freedom Fighters, Julius Malema will be opposing his sequestration that is due on Monday at the North Gauteng High Court. This was revealed by his legal advisor, Tumi Mokwena on Friday in response to media enquiries.

According to the South African Revenue Services (SARS), Malema owes the taxman more than sixteen million rand in taxes and interest which emanate from the non-submission of tax returns between 2006 and 2010.

In 2010, SARS contacted the then ANC youth league leader about the outstanding tax returns and it took close to two years of petitioning and cajoling on the part of SARS to get these. In addition, Malema had not registered his Ratanang Trust and SARS had to do it on his behalf. The trust was reported to be about three million rand in arrears with the taxman.

In February, after appearing before Judge Bill Prinsloo, it was ruled that the firebrand political leader’s property be sequestrated temporarily until the 26th of May, 2014. The sequestration entailed holding the property in trust so that it cannot be sold in order to ensure that there would be money available for the payment of the SARS tax bills. The onus was upon the defendant, Julius Malema or anyone else to contest the sequestration before the expiry at 10:00 am on the 26th of May, 2014. At this hearing, they need to give reasons why this sequestration should not go ahead. According to Malema’s lawyer, Mokwena said that they were working on papers to contest this sequestration.

If the sequestration is allowed to go ahead, this would have negative repercussions on Malema’s political career as it would mean that he cannot stand as a member of parliament despite the fact that he was sworn in on Wednesday.

    Malema and zuma know the loophole in our legal system so they will be away for him to gwt around it just like the old man simple the trick they use is that they do it on the last minute like someone who just woke up from death so am very sure come 26th he will still be standing lol

    Now that he is earning real, legitimate money, perhaps the SARS can apply for a garnishee order.
